Terms of Service for Asphalt Lots VA – Parking Garage

Welcome to Asphalt Lots VA – Parking Garage! By using our monthly, daily parking, or transportation services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). These Terms govern your use of our parking facilities, website, mobile application, and related transportation offerings. Please read them carefully. If you do not agree, you may not use our Services.

1. Eligibility
You must be at least 18 years old and have legal capacity to enter into contracts.
By using the Services, you confirm that you meet these requirements.


2. Use of Services
Permitted Use
You may use our Services solely for lawful purposes, such as parking your vehicle or utilizing our transportation (e.g., shuttles to ports or destinations).

Prohibited Conduct
You agree not to:

Violate any federal, state, or local laws, including Virginia law.
Park unauthorized vehicles or use unassigned spaces.
Damage property, disrupt operations, or endanger others.
Store hazardous materials or engage in illegal activity.
Share account credentials or allow unauthorized access.


3. Accounts & Security
Responsibility: You are responsible for maintaining the confidentiality of your account credentials.
Security: Notify us immediately at [email protected] if you suspect unauthorized use or a security breach.
Accuracy: Provide accurate, current information when registering or reserving, and update it promptly if it changes.


4. Fees & Payments
Pricing: Fees for parking or transportation are listed on our website or at our facilities in U.S. dollars, plus applicable taxes.
Payment: Pay all fees promptly via approved methods (credit/debit card, mobile payment, etc.).
Refunds: Refunds follow our posted refund policy; no refunds for unused parking time unless required by Virginia law.
Late Payments: Late or missed payments may incur fees and may result in suspension or termination of access.


5. Service Modifications & Termination
Modifications: We may modify, suspend, or discontinue Services (e.g., parking availability, shuttle schedules) without prior notice, subject to applicable law.
Termination by Us: We may terminate or suspend your access for:Violation of these Terms.
Non-payment.
Misuse of facilities or Services.
Conduct posing a risk to safety or property.
Termination by You: Cancel monthly parking with 30 days’ written notice to [email protected], subject to our refund policy.


6. Liability & Disclaimers
Use at Your Own Risk: Use of our Services is at your own risk. We are not responsible for damage to, loss of, or theft of your vehicle or personal property, except where caused by our gross negligence or willful misconduct, as limited by Virginia law.
No Warranty: Services are provided “as is,” without warranties of any kind, including fitness for a particular purpose or uninterrupted access.
Limitation of Liability: Our liability is limited to the amount you paid for Services in the past 12 months. We are not liable for indirect, incidental, or consequential damages.

 

7. Lost or Damaged Luggage (Transportation Services) – Updated per Virginia Law
Asphalt Lots VA acts solely as a common carrier for hire under Virginia Code § 46.2-2000 et seq. and is not a bailee for luggage. We accept no responsibility for lost, stolen, or damaged bags unless the loss or damage is directly and proximately caused by our gross negligence or willful misconduct while the bag is in our actual physical possession during active loading/unloading or transport in our vehicle.

Specific Exclusions (No Liability Whatsoever)
Lost bags originating from Carnival Cruise Line (or any cruise ship): We receive only what is handed to us by the passenger or cruise porter. We are not responsible for any shortage, loss, or damage occurring prior to our driver taking physical custody.
Unattended bags or luggage: Any bag left unattended on the lot, pier, or elsewhere is at the owner’s sole risk. We do not monitor, guard, or insure unattended items.
Hand-back policy: Our driver will hand back exactly what was received during loading. Passenger must count and verify items before the van departs. Discrepancies noted after departure are not our responsibility.

Claims filed after the passenger leaves the relevant location will not be considered (Va. Code § 8.01-246 limitation principles applied).

Compensation (Strictly Limited)
Maximum liability: $1,500 per passenger/claim, only if gross negligence is proven by clear and convincing evidence.
Required documentation: Original receipts, completed official Lost/Damaged Luggage Claim Form (available on request), and police report (if theft alleged).
No consequential damages: We are not liable for travel delays, replacement costs exceeding actual cash value, sentimental value, or any indirect loss.
By using our service, you agree to these terms and acknowledge Virginia law governs (Va. Code § 8.2-701 et seq. for common carriers).


8. Monitoring & Compliance
We may monitor the Services (including cameras and license plate recognition) for compliance, security, and operations. By using the Services, you consent to this monitoring and the collection of related vehicle information.

9. Intellectual Property
All content, trademarks, and materials (logos, designs, text, etc.) are owned by Asphalt Lots VA or its licensors. You may not use, copy, or distribute them without prior written permission.

10. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by Virginia law, without regard to conflict-of-law principles.
Dispute Resolution: Disputes will first be addressed through good-faith negotiation, then mediation in Richmond, Virginia, if needed. 

Legal actions must be filed in Richmond courts, and you consent to their jurisdiction.


11. Indemnification
You agree to indemnify and hold harmless Asphalt Lots VA, its affiliates, and employees from any claims, damages, or losses arising from your violation of these Terms, misuse of the Services, or violation of applicable laws.

12. Changes to These Terms
We may update these Terms to reflect service changes or legal requirements. Significant changes will be posted on our website or emailed to [email protected]. Continued use after changes constitutes acceptance.
